The Fight Over Your Listing Reached My Own MLS
The biggest industry story this month landed in my own backyard. On September 8, Compass sent a demand letter to CRMLS, the large Southern California MLS that covers the Coachella Valley. Compass wants CRMLS to stop fining agents who publicly advertise "office exclusive" listings, homes marketed to the public but kept off the MLS. Those fines run $500 to $2,500. Compass set an October 6 deadline and said it would file a federal antitrust suit if CRMLS didn't change. On September 30, CRMLS said no. It also said it will countersue under California law if Compass follows through.
Why this matters here: if you sell in La Quinta or Palm Desert, the MLS is how every agent and every home search site sees your home at the same time. When a listing is held back, fewer buyers see it. Fewer buyers usually means less competition for your home. That is why I put my listings on the MLS. If someone pitches you a "private" launch, ask who gets left out.
Same Fight, Other Fronts
The same fight is playing out on other fronts. In Washington state, Compass settled with the Northwest MLS, which now offers a "First Look" option, a short MLS-approved window before full marketing. On September 22, Compass launched "See It First," a site that shows coming soon and exclusive listings across its brands, without days on market or price drops.
Zillow had a busy month in court too. A federal judge refused Zillow's request to stop the Chicago MLS from enforcing its listing rules. On September 28, a Seattle judge let an antitrust suit from agents move forward. It claims Zillow ties buyer leads to how many clients agents steer to Zillow Home Loans. Zillow is also asking that judge to toss a separate consumer suit over mortgage steering for good, and it faces two shareholder suits. What it means for you: you can always shop your loan. Get at least two quotes, no matter who referred the lender.
The Commission Lawsuits Are Basically Over
The commission lawsuits are basically over. An appeals court upheld the Sitzer/Burnett settlement, worth more than $1 billion, on August 19. It upheld a separate $110.6 million set of brokerage settlements on September 1, then turned down the last rehearing requests on September 24. Locally, nothing changes from what you've seen since 2024. Commissions are negotiable, and buyers sign a written agreement with their agent before touring.
One thing you can act on: if you bought a home listed on an MLS during certain years, you may qualify for a separate $120 million homebuyer settlement. The claim deadline is October 27, 2026. Details are at homebuyersettlement.com.
Bigger Brokerages
Brokerages keep getting bigger. Real Brokerage closed its $880 million purchase of RE/MAX on August 24, creating a company of about 180,000 agents. Its first big move was to stop selling new Motto Mortgage franchises. This is mostly inside baseball for buyers and sellers. The agent you hire matters far more than the sign on the door.
The Story That Hits Your Wallet: Insurance
The story that hits your wallet is insurance. California FAIR Plan rates are going up about 29% on average this October. LA County also sued State Farm over how it handled wildfire claims. If you own here or plan to buy here, get an insurance quote early, before you're in escrow.
Quick Notes
A few quick notes with little local impact: KKR paid $250 million to settle a Justice Department case over merger filings. The DOJ settled with Pinnacle in its RealPage rent pricing case. A Texas broker lost his appeal challenging NAR's MLS membership rule. Louisiana brokers sued their own association to undo an MLS merger. Valuation company HouseCanary filed Chapter 11 months after winning a $175 million verdict against Rocket's Amrock.
My Take
My take: most of this month's headlines are big companies fighting over who controls your listing. My job is simpler. I put your home in front of every buyer, give you the real numbers, and never pressure you.
